Terms and Conditions

 

1. Acceptance of Terms

By booking with The Tipsy Twist Co., you agree to these Terms of Service. These terms apply to all rentals, services, and website interactions on thetipsytwistco.com.

2. Alcohol Disclaimer & Texas Law

The Tipsy Twist Co. does not sell, serve, or provide alcohol in any form.
In accordance with Texas Alcoholic Beverage Commission (TABC) laws, the company cannot distribute or include alcohol in any rental or event service.
Customers must supply their own alcoholic beverages and are fully responsible for compliance with all state and local regulations regarding alcohol use and consumption.

3. Booking & Payment

  • A non-refundable deposit of 30% of the total rental cost is required at the time of reservation.
     
  • The remaining balance is due the morning of the event, prior to delivery.
     
  • Payments are processed securely through Square.
     
  • Bookings are not confirmed until the deposit has been received.
     

4. Cancellations & Rescheduling

All deposits are non-refundable. Rescheduling is permitted pending company availability.
If a reschedule cannot be accommodated, the deposit will not be refunded.

5. Equipment Use

Customers agree to:

  • Operate the frozen drink machine as instructed.
     
  • Avoid moving or tampering with the equipment once set up.
     
  • Provide a standard 120 V outlet and ensure safe electrical connections.
     
  • Protect the machine from water, rain, or other hazards.
     

6. Damages & Liability

Customers are financially responsible for any lost, stolen, or damaged equipment.
The Tipsy Twist Co. assumes no liability for accidents, injuries, or damages resulting from alcohol consumption, misuse, or negligence.

7. Weather Policy

The company provides an umbrella for sun protection.
If rain or other adverse weather is expected, the customer must supply cover or tenting to protect the equipment.
Unsafe weather conditions may result in cancellation or rescheduling at our discretion.

8. Indemnification

Customer agrees to indemnify and hold harmless The Tipsy Twist Co., its owners, and employees from any claims, damages, or expenses arising from the use of the equipment or services.

9. Privacy

Personal information collected for booking or payments will only be used for business communication and will never be shared or sold.

10. Modifications

The Tipsy Twist Co. reserves the right to update these Terms of Service at any time. The most recent version will always be posted on our website.


Return and Refund Policy

 

At The Tipsy Twist Co., we value our customers and aim to provide a smooth rental experience for every event. Because our services involve time-based equipment rentals and advance event preparation, our policy differs from typical product returns. Please review our Return and Refund Policy below.

1. Deposits and Payments

  • A non-refundable deposit of 30% of the total rental cost is required to secure your booking.
     
  • This deposit is applied toward your final balance and cannot be refunded under any circumstances, even if the event is canceled.
     
  • The remaining balance is due the morning of the event before delivery.
     

2. Cancellations and Rescheduling

  • If you need to cancel your booking, please notify us as soon as possible.
     
  • Cancellations made 7 days or more before the event can be rescheduled for a future date, pending our availability.
     
  • Cancellations made less than 7 days before the event will forfeit the deposit and may be subject to additional fees if delivery was already prepared or attempted.
     

3. Returns and Equipment Condition

  • Because we provide a rental service, physical “returns” do not apply.
     
  • The client is responsible for ensuring all equipment remains in good working condition throughout the rental period.
     
  • Any damage, loss, or misuse of equipment may result in a charge up to the full replacement cost ($2,500) for the frozen drink machine.
     

4. Refund Eligibility

Refunds may only be issued under the following conditions:

  • If The Tipsy Twist Co. cancels the event due to equipment malfunction or an unavoidable issue on our end.
     
  • If an event is canceled by us due to unsafe weather and rescheduling is not possible.
     

Refunds will be processed to the original payment method within 5–7 business days if approved.
